I 1986 C charged the property to L to secure a loan without informing them X lived there. In 1991, L sought repayment of the loan and subsequent possession of the property. C claimed he held the property as bare trustee for X. L claimed X`s interest was as an unregistered contract and was therefore void against them. L`s appeal against an earlier decision that there was no registrable interest upheld.
