ChD 16 May 1997. Plaintiff company was owner of three properties mortgaged to the defendant bank. By reason of indebtedness of the plaintiff, two of the defendants were appointed receivers and exercised a direct power of sale. The bank and the receivers used the services of KFR, a firm of estate agents. Plaintiff claimed bank ought not to have exercised the power of sale and that marketing advice from KFR was negligent. Held: The actions were dismissed.
