ORD 12 march 1997. P engaged D to provide design and professional services in connection with the redevelopment of a cinema. Contract prices agreed were £467,140 (later £450,000) for the building works and a separate contract for M&E work. Following completion, which was a week after the contractual date, D issued final certificate and final cost of £827,000 including M&E work. P was by then in financial difficulties and after negotiations sold the theatre to a third party.
