R v Teesside Development Corporation, ex parte William Morrison Supermarket plc and Redcar and Cleveland BC

QBD 16 May 1997. A site in an urban development area and subject to control by Teesside Development Corporation was targeted for an extensive development proposal package for residential and commercial purposes including a major food retail unit. Such a retail development was in direct breach of Policy IND7 in the Cleveland Structure Plan which nominated Middlehaven for such a development. Asda made an initial planning permission application which was approved subject to an impact assessment. This assessment showed an at least 25 per cent impact on William Morrison Supermarket`s store nearby. The corporation still resolved to support the application but Redcar and Cleveland BC opposed the development because of the conflict with the Structure Plan. They and William Morrison Supermarket plc alleged that the Corporation had lacked objectivity and prejudged the outcome of its deliberations. Application allowed.
