QBD 2 December 1999. The claimants R were granted planning permission for a development subject to a time limit of five years. The plans were commenced within the deadline, but then came to a halt and did not resume until four years later. The work stopped again and SB claimed that the orginal planning permission had lapsed because R lacked the genuine intention of carrying out the development. Held, claim allowed.
