"E H Cardy & Son v Edward Vye Taylor and Paul Roberts & Associates (a firm) (third party)" ORB 10 February 1994. The defendant hotelier was awarded damages for loss as C, a builder, had failed to conduct proper site measurements resulting in building delays, lower star-rating and subsequent forced sale of the finished hotel. The third party, a firm of architects, subcontracted by C to undertake design, was held to be liable in negligence.
