In considering Excelsior Commercial & Industrial Holdings Ltd v Salisbury Hamer Aspden & Johnson Betesh & Co, the Court of Appeal declined to offer guidance on costs order. Judges ruled that the circumstances in which a court may be concerned with costs and payments may vary considerably as an infinite variety of situations existed that might go to court justifying the making of a cost order.
