Reviews the consequences of the CA decision in , "Rice v Great Yarmouth BC" ( CA [2003] TCLR 1)E It concerned whether a local authority GY was entitled to terminate two contracts it made with a horticultural contractor. GY had served many default notices under the contract which contained a clause allowing it to terminate the contractor's employment with immediate effect if any of the obligations were breached. The contractor admitted that a number of breaches had occurred, but surprisingly, CA agreed that the terminations were invalid.
