Not 'adverse' possession
Webber, G
Not 'adverse' possession - 2002 - Solicitors' Journal 146(28) 19 July 2002, 652-653(2) .
Reports on the House of Lords' decision in "J A Pye(Oxford) Ltd v Graham" which examined whether a trespasser 'possessed' the land for the requisite period using the ordinary meaning of the word. Decision concluded that even if a person is in possession with the consent of the owner, he does not have sufficient possession for the purposes of the Limitation Act 1980. However, the Land Registration Act 2002, which comes into force in 2003, will radically change this position.
