TCC 27 November 2002. Claimant (C)'s application for summary judgment to enforce adjudicator's decision was dismissed. An oral agreement varying terms of a contract did not form part of a written contract and therefore the Housing Grants, Construction and Regeneration Act 1996 s107 did not apply. "R J T Consulting v D M Engineering" (CA X118297) applied. There was no dispute to refer to adjudication as C had failed to provide clarification of its claim as requested by defendant (D).
