EC Human Rights 22 November 1995. In 1989 an enforcement notice was served on B requiring the demolition of two brick buildings which had no planning permission. B appealed to SoS Environment who upheld the local council`s decision, a further appeal was dismissed by the High Court. The appellant had argued that the buildings were for agricultural purposes and were not constructed as residential dwellings. Leave to appeal to CA refused. B then alleged his rights had been violated under article 6 of the European Convention on Human Rights, i.e. right to fair and public hearing. The Commission observed that the decision of the inspector appointed by the SoS was carefully reasoned and the HC adequately dealt with B`s submissions and therefore concluded that there had been no violation of B`s rights.
