B appealed to SoS Environment who upheld the local council`s decision, a further appeal was dismissed by the High Court. The appellant had argued that the buildings were for agricultural purposes and were not constructed as residential dwellings. Leave to appeal to CA refused. B then alleged his rights had been violated under article 6 of the European Convention on Human Rights, i.e. right to fair and public hearing.
