| Summary, etc. | QBD 21 December 1987. In 1985 a Grade 2 timber framed listed barn was dismantled and the framing sold, but some 70% of the timbers were not suitable for re-erection. The purchasers entered an agreement with the defendant company with the intention of exporting the timbers to the USA. In August 1986 the district council issued a writ against the defendants which enabled them to acquire the timbers. The council then served a listed building enforcement notice . The council raised two points (1) did a planning authority have power to serve this notice notwithstanding that the building to which it related had been demolished and (2) was a person capable of being regarded as the owner of a listed building when he was the owner of some or all of the extant parts of a building which had been demolished? It was held that both concepts were true and the appeals against the enforcement notice were dismissed. |
