R v Leominster District Council ex parte Antique Country Buildings Ltd

The purchasers entered an agreement with the defendant company with the intention of exporting the timbers to the USA. In August 1986 the district council issued a writ against the defendants which enabled them to acquire the timbers. The council then served a listed building enforcement notice .
