In 1985 a Grade 2 timber framed listed barn was dismantled and the framing sold, but some 70% of the timbers were not suitable for re-erection. The purchasers entered an agreement with the defendant company with the intention of exporting the timbers to the USA. In August 1986 the district council issued a writ against the defendants which enabled them to acquire the timbers. The council then served a listed building enforcement notice .
