Summary, etc. HL 1 December 1988. An appeal from a decision in the QBD where the appellant estate agent was found guilty of unlawful display of a for sale board under the Town and Country Planning (Control of Advertisements) Regulations 1984.(See Abstract 39216). At issue was whether an estate agent given instruction to sell or let a residential property committed an offence if, after lawfully displaying a for sale board outside a property, another agent with or without the first agent`s knowledge, displays a second board. It was held in the HL, reversing the decision of the QBD, that no offence is committed by the first agent in these circumstances. Appeal allowed.
