At issue was whether an estate agent given instruction to sell or let a residential property committed an offence if, after lawfully displaying a for sale board outside a property, another agent with or without the first agent`s knowledge, displays a second board. It was held in the HL, reversing the decision of the QBD, that no offence is committed by the first agent in these circumstances. Appeal allowed.
