Mr Richardson (R), the plaintiff claimed damages against the local authority (W) for negligence or breach of duty in performing its functions under the building regulations , in respect of an extension to R`s house. R claimed that W failed to inspect adequately during construction. The judge had decided that no duty was owed by the W. R appealed but the case was dismissed.
