Summary, etc. LT 23 March 1992. Concerned a disagreement over the compensation payable for the compulsory purchase of an unfit two-bedroomed terraced house in a clearance area. The site value was agreed at £750 and the full compulsory purchase value at £26,000 giving an owner-occupation supplement of £25,250. The later was only payable if the house had been wholly or partly occupied as a private dwelling during the two years previous to the area being declared a clearance area. The `qualifying period` was 18 December 1982 to 18 December 1984. The claimant had bought the property in mid 1982 but his family remained in another house until he did repairs. About 75% of their furniture was moved in November 1982 and the family moved in in early 1983 after which they went to India for six months. He was given a void rate allowance for the property from December 1982 to December 1983. He paid water and electricity charges but did not register on the electoral register until 1984. The council claimed that
