Says how much the CDM has been criticised for introducing bureaucracy into the industry and being difficult to enforce and implement. Argues that when the CDM is reformed it should follow the good practice set down in the Construction Act 1996 which requires people to put certain terms into their construction contracts governing such items as payment and adjudication. This would give the parties the right to enforce the regulations contractually and also to sue for breach of statutory duty.
