Refers extensively to case law throughout to explain the application of applying an Environmental Impact Assessment (EIA) in a variety of different scenarios including development consents and s73 applications. Traces the origin and development of the EIA concept on a global basis. Looks at the impact of "R v SoS Transport ex parte Wells" (C-201/02, X125853) on a range of EIA scenarios. Mentions the first Privy Council decision on EIA, "Belize Alliance of Conservation Non-Government Organisations v Department of the Environment and another" ([2004] UKPC 6). Comments on "Shiu Wing Steel Ltd v Director Environmental Protection" (HCAL184/2002) with an explanation of the EIA system in Hong Kong. The author notes that " Shiu Wing" is due to go to appeal in September 2004.
