Little (L) wanted to exercise the option in his lease to renew for a further five years, Courage (C) agreed. However C later claimed that L had not submitted a business plan with his application, as required in the lease and his application was therefore refused. Held that L had only to `agree` to a plan, not submit one, so if C did not present L with a plan to sign C could not refuse L`s application to extend the lease on the grounds of there being no business plan attached.
