Looks at recent attempts to resist enforcement of adjudicators' decisions in the Housing Grants, Construction and Regeneration Act 1996 and the way in which they have been dealt with by the courts. Reviews s108 of the Act, which touches on the issue of enforcement and how JCT contracts can provide reinforcement of its position. Concludes that s108 provides a judicial basis for enforcement, under which a construction contract can reinforce that the adjudicator's decision is binding (for part two see Abs66800).
