After the solicitors were instructed, H`s agents wrote to S`s solicitors stating that the sale particulars were inaccurate and there was no main drainage. Unfortunately this information was not passed on to S. H however repeated the misrepresentation in a conversation with S`s surveyor and it was confirmed in the survey report that the house enjoyed main drainage.
