Presents a critical review of all the cases where the courts have dealt with the effects of insolvency on the right to adjudicate and the enforceability of adjudicators' decisions. Argues that the courts may decline to enforce an adjudicator's payment decision when it is concluded that the payee would be unable to make repayment; the only exception to this would occur when the other party is in administration.
