CA 10 November 1995. R claimed rent arrears from S. The third defendant (X), who acted as guarantor for S, applied to dismiss R`s claim for want of prosecution. The application failed on the grounds that the limitation period of 12 years had not expired. X appealed, contending that the Limitation Act 1980 s19 applied and a claim against a guarantor for rent arrears against a guarantor must be brought within a six year period. "Held" the Limitation ACT 1980 s19 applied. Appeal allowed.
