The application failed on the grounds that the limitation period of 12 years had not expired. X appealed, contending that the Limitation Act 1980 s19 applied and a claim against a guarantor for rent arrears against a guarantor must be brought within a six year period. "Held" the Limitation ACT 1980 s19 applied. Appeal allowed.
