Discusses the impact of the Human Rights Act 1998 on the planning system following the "Alconbury" decision. Acknowledges the importance of "Alconbury" which addressed the compatibility of the call-in decision-making process with the European Convention on Human Rights Article 6 requirement to a fair hearing, but suggests that "Alconbury" has its limitations and should not represent the final word.
